3월에 있었던 2차 재판의 판결이 4월 28일에 있었는데, 중범죄로 기소된 것이 경범으로 낮춰져서 3년 집행유예판결이 났습니다.

지금은 유바카운티에 있는 이민국 수감소에 갇혀있고 앞으로 이민국과의 재판이 남아 있습니다.

Dear supporter of Nan-Hui Jo,

Nan-Hui is now in ICE custody and faces the serious possibility of deportation.

In March, Nan-Hui Jo was convicted on charges of ‘child abduction.’ Yesterday, Nan-Hui’s conviction was lowered from a felony to a misdemeanor, and she was sentenced her to three years of probation and 175 days in county jail. Having spent over 9 months incarcerated during trial proceedings, Nan-Hui’s jail time was counted as “time served,” and she was eligible for release. Supporters greeted her upon her release from Yolo County jail, but Nan-Hui was immediately taken into Immigration and Customs Enforcement (ICE) custody and transferred to Yuba County Jail, which also functions as an immigration detention center. She is still awaiting processing from Sacramento ICE and faces the possibility of indefinite detention and/or deportation.

Here is what we know:

• Nan-Hui is now in ICE’s custody. ICE maintains jurisdiction around her continued detention.

• She has the right to attend an upcoming hearing in immigration court and should not be detained and/or deported prior to her scheduled court date.

• Her attorneys have filed multiple immigration applications that should let her stay and work towards reunification with her daughter.

• Nan-Hui also has upcoming family court hearings that she needs to attend. Staying in detention only hurts her family court case. She cannot see or have any visitation with her daughter while incarcerated by ICE.
